Local laws are designed to protect the community and local environment from health and safety concerns, and make living in the Shire of Carnarvon pleasant for all residents. Local laws help you understand your rights and responsibilities, and promote understanding and cooperation. Prior to 1995, local laws were referred to as ‘by-laws’ and all local governments in Western Australia have local laws which in the case of the Shire of Carnarvon, are administered by Shire officers.
Our local laws may be different from the local laws in other municipalities. Local laws are dynamic and as such, changes made in legislation may lead to current or new local laws being reviewed by Council at any time. There is always a statewide public notice period given when these reviews are undertaken. Local laws are required to be reviewed every eight years under the Local Government Act 1995. A review of our local laws has recently been undertaken.
Cat Local Law
The purpose of the local law is to set a ‘standard number’ of cats that may be kept on premises. The effect is that persons must not keep more than the standard number of cats unless provided for by the local law, the Cat Act, or its associated Regulations.

Dog Local Law
The purpose is to make provisions about the confinement of dogs, control the number of dogs that can be kept on premises in the district, and require the removal of dog excreta. The effect is to extend the controls over dogs that exist under the Dog Act 1976 and Regulations.

Health Local Law
The purpose is to enable the Shire to regulate health, sanitation, pest control, keeping of livestock and poultry, lodging houses, nuisances and general health related controls within the Shire of Carnarvon.

Health Amendment Local Law 2002
The purpose is to amend the Shire of Carnarvon Health Local Laws 1997 to prohibit the release of pigeons within the district by a person who is not also an owner or occupier of property in the district and to correct an error in clause 70(3) of the local law. The effect is that the Shire of Carnarvon Health Local Laws 1997 are amended.

Parking Local Law
The purpose is to enable the Shire to regulate the parking of vehicles within the district and provide for the management and operation of parking facilities under the Shire’s care, control and management. The effect is that a person parking a vehicle within the parking region is to comply with the provisions of the local law.

Bush Fire Brigades Local Law
The purpose is to provide for the appointment or election of a captain, a first lieutenant, a second lieutenant, and such additional lieutenants as may be necessary as officers of bush fire brigades in the district and prescribe their respective duties. The effect is that the appointment or election of a captain, a first lieutenant, a second lieutenant, and such additional lieutenants as may be necessary as officers of bush fire brigades in the district is prescribed, as are their respective duties.

Cemeteries Amendment Local Law
The purpose is to amend the Shire of Carnarvon Local Laws Relating to the Carnarvon Public Cemetery 1998 to replace ‘council’ with ‘local government’ wherever it occurs, to amend provisions relating to assistance animals, and to update applicable penalties under the local law. The effect is that the Shire of Carnarvon Local Laws Relating to the Carnarvon Public Cemetery 1998 is amended.

Meeting Procedures Local Law
The purpose is to regulate the conduct of council, committee and electors’ meetings. The effect is that meetings of council, committees and electors are to be conducted in accordance with the local law.

Waste Local Law
The purpose of the local law is to regulate the storage, collection and disposal of waste and refuse from premises and on waste facilities in the Shire. The effect is that unless otherwise authorised, the storage, collection and disposal of waste and refuse within the Shire must be carried out in accordance with the provisions of the local law.

Public Places and Local Government Property Local Law
The purpose is to regulate the care, control and management of the property of and under the care, control and management of the Shire including thoroughfares. The effect is that some Shire property is set aside for particular uses, some activities are allowed only under a permit or under a determination, and others are restricted or prohibited. The local law also establishes offences for inappropriate behaviour in or on Shire property.
The Shire of Carnarvon Public Places and Local Government Local Law 2021 was amended and the amendment will come into effect on 6 September 2022.
The purpose of the local law is to amend the Shire of Carnarvon Public Places and Local Government Property Local Law 2021 to clarify its application to animals in or on local government property and to correct an incorrect reference to other legislation. The effect is that the Shire of Carnarvon Public Places and Local Government Property Local Law 2021 is amended.
